承諾 Promises and Undertakes
發包人承諾按照法律規定履行計畫審批手續、籌集工程建設資金並按照合約約定的期限和方式支付合約價款。
The employer promises, in accordance with laws provisions, perform the approval procedures, raise construction funds and effect payment of contracted cost and price pursuant to the time limited and methods which are stipulated in contract.
承包人承諾按照法律規定及合約約定組織完成工程施工，確保工程品質和安全，不進行轉包及違法分包，並在缺陷責任期及保修期內承擔相應的工程維修責任。
The contractor promises, in accordance with laws provisions and contract stipulation, to organize and complete the construction, ensure the quality and safety of engineering, no transfer-contracting / subcontracting, and undertake the corresponding liabilities of engineering repair / maintenance in the defects liability period and warranty period.
發包人和承包人透過招投標形式簽訂合約的，雙方理解並承諾不再就同一工程另行簽訂與合約實質性內容相背離的協定。
Where the contract is concluded by bidding between the employer and the contractor, the parties hereto understanding and commitment not to conclude any other agreement which deviate from the substance of this contract.
Contractor’s Undertaking承包商的承諾
The Contractor undertakes that the design, the Contractor’s Documents, the execution and the completed works will be in accordance with:
承包商承諾其設計、承包商檔、實施和竣工的工程符合:
承包人向發包人承諾按照合約約定進行施工、竣工並在品質保修期內承擔工程品質保修責任。
The contractor promises to the employer that he shall carry out and complete all of the construction works in accordance with the contractual provisions hereunder, and will undertake the responsibility of quality warranty for the project within the quality warranty period.
發包人向承包人承諾按照合約約定的期限和方式支付合約價款及其他應當支付的款項。
The employer promises to the contractor that he shall pay to the contractor the contract price and any other payable amounts in accordance with the payment terms and methods as agreed in the contract.
承包人明確並且承諾，在工程建造過程中承包人或其雇員不會對任何涉及施工的個人或者公司試圖受賄或者受賄。
It is understand and agreed that, the Contractor or their employees do not try to bribe or actually bribe any in the construction involved persons or companies.
投標方投標的承諾以及滿足裝置效能要求而實施的車間檢驗和試驗的詳細內容。
Bidder’s proposed Guarantees and completed details of shop Test & Inspection to satisfy the Performance requirements.
考慮到以下提到的委托人向監理人的付款，監理人向委托人承諾,按照本合約的規定,承擔本合約專用條件中議定範圍內的監理業務.
In consideration of the payment to be made by the Client to the Supervisor as hereinafter mentioned, the Supervisor hereby covenants with the Client to perform supervision services in the scope as stated in the Conditions of Particular Application in conformity with the provisions of the Contract.
考慮到監理人提供的監理服務，委托人向監理人承諾按照本合約註明的期限,方式,幣種,向監理人支付報酬.
The Client hereby covenants to pay the Supervisor, in consideration of the performance of the supervision services, such amount as may become payable under the provisions of the Contract at the times and in the manner and currency type prescribed by the Contract.
供應方同意和承諾，其將根據本合約規定的標準、規格和要求，令購買方滿意地供應本合約項下的貨物和服務（下稱「服務」），及購買方應按照本合約的規定向供應方支付合約價格。
Vendor agrees and undertakes to supply the goods and services (「Services」) under this Contract in accordance with the standards, specifications and requirements expressed in this Contract and to the satisfaction of Buyer, and Buyer shall pay Vendor the Contract Price as specified hereunder.
承包商承諾達到附錄8（效能擔保）規定的效能擔保值，並符合第1 卷（ITB） GC28 的規定。
The Contractor guarantees the attainment of the Performance Guarantees specified in Performance Guarantees (Appendix 8) hereto in accordance with GC 28 (Performance Guarantees) of the General Conditions/Volume 1 – ITB, subject to and upon the conditions specified in Performance Guarantees (Appendix8) hereto.
計畫公司成立後30日內，甲方應以書面形式向計畫公司承諾其無條件、不可撤銷的、同意履行本合約中為甲方設定的全部義務和責任。
Party A should, within 30 days upon and after establishment thereof, make representative, warranty or guaranty in writing to party B for its unconditional, irrevocable consent to performance of all duties and liabilities which established on party B in this contract.
發包人承諾按照法律規定履行計畫審批手續，按照合約約定提供設計依據，並按合約約定的期限和方式支付合約價款。
The employer promises to perform project approval procedures in accordance with the law, provide design basis according to the contract, and pay the contract price as the time limit and method stipulated herein.
設計人承諾按照法律和技術標準規定及合約約定提供工程設計服務。
The designer promises to provide engineering design services in accordance with legal, technical standards and contractual agreements.
我方在此承諾：根據下述特別說明的第1和第2條，按照本信用證下出具的符合本信用證條件的匯票和裝運單據予以議付。
We hereby undertake that against presentation of the drafts and shipping documents drawn under and in compliance with the terms of this Credit, the same shall be negotiated subject to special instructions item 1 and 2 stated hereunder.
每筆最終付款均應有一份「承包商對最終付款的支付、解除及留置權放棄的書面承諾」。該等書面承諾應附有：
Required for each final payment shall be one "Contractor Affidavit of Payment, Release, and Waiver of Liens for Final Payment." Attached thereto shall be the following:
承包商使用的書面承諾、留置權放棄聲明及擔保人同意的格式應由業主提供。
The forms for the affidavits, waivers of liens, and consents of surety to be used by the Contractor shall be those furnished by the Owner.
每筆分期付款均應有一份針對付款申請所涵蓋工程的「承包商對分期付款的支付、解除及留置權放棄的書面承諾」。該等書面承諾應附有：
Required for each progress payment shall be one "Contractor Affidavit of Payment, Release, and Waiver of Liens for Progress Payment" for the Work covered by the Application for Payment. Attached to that affidavit shall be the following:
針對付款申請金額中可歸因於分包商和材料供應商工程的部份，從該等分包商（包括材料供應商）獲得下列其中一項分包商和材料供應商的書面承諾：
One of the following subcontractors and material supplier affidavits from each Subcontractors, including each material supplier, for that portion of the sum set forth in the Application which is attributable to his portion of the Work:
(1) 如果其工程仍在進行中，「分包商和材料供應商對分期付款的支付、解除及留置權放棄的書面承諾」。
A "Subcontractors and Material Supplier Affidavit of Payment, Release, and Waiver of Liens for Progress Payment" if the Work by him is still in progress.
(2) 如果其工程已竣工，「分包商和材料供應商對最終付款的支付、解除及留置權放棄的書面承諾」。
A "Subcontractors and Material Supplier Affidavit of Payment, Release, and Waiver of Liens for Final Payment" if the Work by him is complete.
The Company acknowledges to EDC that it remains liable to EDC to perform all the liabilities and obligations assumed by the Company under the Contract.
公司向EDC承諾仍然承擔合約規定的應向EDC履行的相關責任和義務。
受托人在本承諾函項下對貴司的付款義務無附加條件，受托人承諾不因委托人未履行與受托人的約定或認為貴司違反目標協定或其他原因而抗辯履行本承諾函項下的付款義務。
委托人與受托人在委托款項的金額範圍內承擔連帶付款責任。如果受托人未能在規定期限按規定方式支付全部委托款項，則視為受托人違反了本承諾函、委托人違反了本承諾函及目標協定。貴司可以向委托人與受托人同時求償並追究違約責任。
The Consignee shall pay you according to this Promise without any additional condition. And the Consignee promises not to defend any paying obligation under this Promise because the Consignor fails to perform the agreement with the Consignee or the Consignor deems you have breached the target agreement or any other reason.
The Consigner and the Consignee shall undertake incidental responsibility in the amount range of the entrusted payment. If the Consignee fails to pay all entrusted payment in the specified time and in specified term, then the Consignee will be deemed as has breached this Promise, and the Consignor has breached this Promise and the target agreement. You can claim compensation and hold the Consignor and the Consignee to be responsible for breaching the agreement.
Consortium shall undertake to guarantee the performance parameters specified in the following schedules based on the following reference conditions:
聯合體承諾在下列條件下，擔保下表中的效能參數：
發包人承諾按照法律規定履行計畫審批手續，按照合約約定提供工程勘察條件和相關資料，並按照合約約定的期限和方式支付合約價款。
The employer promises to perform the project approval procedures in accordance with the law, provide engineering survey conditions and relevant materials as per the contract and pay the contract price according to the time limit and method as stipulated herein.
勘察人承諾按照法律法規和技術標準規定及合約約定提供勘察技術服務。
Surveyor promises to provide survey technical services in accordance with laws, regulations, technical standards and contractual agreements
